Legal Guarantee

Rights from Liability for Defects (Legal Guarantee) and Product Specifics

1. Legal Guarantee

1. All goods sold are covered by a statutory legal guarantee (liability for defects) of 24 months, unless stated otherwise for a specific case. The warranty period begins on the day the goods are received by the buyer.

2. The seller is liable for defects present at the time of delivery, as well as for defects that manifest during the warranty period.

3. In the event of a justified defect, the buyer – consumer has the right to free removal of the defect (repair), replacement of the goods, a reasonable discount on the purchase price, or withdrawal from the contract in accordance with generally binding legal regulations.

2. Specifics of Handmade Production and Artworks

The buyer acknowledges and agrees that the offered goods have the character of works of art and handmade products, which involves the following specifics:

• Painted Artworks / Paintings:

• These are original works. Minor deviations in paint texture, brushstrokes, or final details compared to photographs on the e-shop are a natural sign of original handmade work and the uniqueness of each painting.

• Paintings must be protected from direct sunlight, excessive humidity, and sharp temperature fluctuations, which could damage the canvas or colors.

• Earrings and Jewelry:

• Natural oxidation (darkening) of metal parts (silver, brass) due to wear, air, or sweat is not a product defect, but a natural property of the metal.

• Any minor deviations in shape, component placement, or color of minerals/materials are a result of handmade production.

• Bags and Textile Accessories:

• Natural wear and tear of the material (e.g., gradual fading of colors, minor pilling of the fabric) caused by normal use and washing is not considered a defect.

• Postcards and Paper Products:

• Paper and cardboard are sensitive materials. Mechanical damage (bending, tearing, exposure to moisture) caused by improper handling is not subject to a claim.

3. Exclusion of Liability for Defects

The warranty and liability for defects do not apply to damage and changes caused by:

• normal wear and tear corresponding to the duration or manner of use of the goods,

• mechanical damage caused by the buyer (drops, scratches, tearing, breaking),

• improper handling, maintenance, cleaning, or storage contrary to the seller’s recommendations,

• exposure of the goods to inappropriate conditions (moisture, extreme heat, chemicals).
